Always request a supporting deposition

If you are mailing your New York traffic ticket back to court yourself, there are two things I recommend doing:

  1. plead not guilty, and

  2. request a supporting deposition.

The first point I’ve covered before, but the short answer is that you should always plead not guilty.

Asking for a supporting deposition involves checking off a box before mailing in the ticket, but if you don’t understand it then you might not check that box. A supporting deposition is the main evidence in a traffic case: a statement written by the officer, explaining what the officer thinks you did wrong.

Some people won’t check the box because they are worried that it’s going to annoy the officer by asking them to do more work. Put that worry aside. There’s actually a law that protects your right to a supporting deposition by setting a deadline. If the officer gets the request on time and doesn’t send a supporting deposition by the deadline, the case may be dismissed, and at the very least it’s going to make it easier to negotiate with the prosecutor.
